COURT ORDERS DEREGISTRATION OF ADC, FOUR OTHER POLITICAL PARTIES

Delivering judgment, Justice Lifu directed the Independent National Electoral Commission (INEC) to remove the affected parties from its register, citing their inability to meet the stipulated electoral performance threshold, including securing at least 25 per cent of votes in relevant elections as required by law.

The affected political parties include the ADC, Accord (A), Action Alliance (AA), Action Peoples Party (APP), and Zenith Labour Party (ZLP).

The court also restrained INEC from allowing the parties to participate in future elections, including the 2027 general polls, on the grounds that they had failed to meet the constitutional benchmark for continued existence as political parties.

Justice Lifu had earlier dismissed several preliminary objections raised by the defendants before proceeding to the substantive judgment.

The case was filed by the Incorporated Trustees of the National Forum of Former Legislators, who sought the deregistration of the political parties on grounds of alleged non-compliance with electoral laws.

The group joined the Attorney-General of the Federation (AGF) in the suit, while naming INEC as the first defendant.

The plaintiffs argued that the affected parties failed to demonstrate adequate national spread and electoral performance as required under the Constitution, insisting that political parties must secure at least 25 per cent of votes in prescribed elections to remain valid.

They further maintained that none of the defendants successfully countered the claims before the court, urging it to grant the reliefs sought, including their deregistration.
