The Federal High Court sitting in Abuja has struck out a suit challenging the nomination of former Attorney‑General of the Federation, Abubakar Malami, SAN, as the governorship candidate of the African Democratic Congress (ADC) for Kebbi State in the 2027 elections.
Delivering judgment on Tuesday, Justice M. G. Umar held that the plaintiff, Abdulrazak Isa Iko, failed to establish that he participated in the ADC governorship primaries. The court reasoned that without proof of participation, the plaintiff lacked the requisite locus standi to question the outcome of the party’s internal exercise.
On that basis, the court dismissed the case in its entirety, affirming Malami’s candidacy under the ADC. Justice Umar further noted that once the issue of standing was resolved against the plaintiff, no substantive ground remained for the suit to continue.
The ruling supports Nigerian electoral jurisprudence: only aspirants who can demonstrate active participation in a political party’s primary election have the legal right to challenge its conduct in court.
By this decision, Malami’s nomination remains intact, clearing the path for his candidacy as preparations for the 2027 governorship election in Kebbi State proceed.
