A lawsuit filed by advocacy organizations including the Catholic Legal Immigration Network and African Communities Together has given succor to all the countries given visa ban by US President, Donald Trump.
In a ruling by U.S. District Judge Jeannette Vargas in Manhattan, he struck down the Trump administration’s policy that suspended immigrant visa processing for applicants from 75 nations which includes Nigeria.
The US President had placed total and partial visa bans on selected countries, with some countries getting as much as $15,000 to $20,000 bond if the visa is approved and the bond forfeited if the visa holder violates the visa rules.
Judge Vargas ruled that the action of Trump is “patently unlawful,” noting that violates federal immigration law by overriding the independent statutory authority of consular officers which power is derived from congress and exceeded Secretary of State Marco Rubio’s statutory authority.
The policy, which took effect on January 21, 2026, stopped immigrant visa issuance for citizens of countries including Russia, Belarus, Moldova, Armenia, Georgia, Kazakhstan, Brazil, Colombia, Nigeria, Egypt, Pakistan, and many others.
