The UAE government has announced the formal categories of foreigners eligible for a Non-Working Residence Permit, which will apply in 2026.

The provision, known as the Non-Working Residency Permit, is covered by Article 46 of the UAE’s residency legislation and is issued by the Federal Authority for Identity and Citizenship (ICA) after approval from the necessary competent authorities.

The official UAE legislation portal explains who qualifies and under what circumstances. The eight eligible categories are listed below:
- A Nigeria student enrolling at a university, college, educational, or research institution licensed by the state.
- A Nigerian who works remotely for an employer or institution located outside of the UAE.
- A foreigner who owns real estate in the UAE.
- Parents, children, and spouses of male and female UAE nationals with foreign passports.
- Family members of a foreigner who is already living in the UAE, including spouses and children, with the option of including parents if the principal resident has a Green Residence Permit.
- Wives and children of GCC nationals with foreign passports.
- Humanitarian pioneers
- A foreign lady whose UAE citizen spouse has died or divorced her, assuming she has at least one child.
- A retired Nigerian worker.
Key Conditions to Note
The permission is not independent of other regulatory requirements. Article 34 of the same resolution outlines the basic requirements that all applicants must complete before the ICA can process their Non-Working Residence Permit application, regardless of which of the nine categories they fall into.
The introduction of remote workers as a recognized category underscores the UAE’s ongoing efforts to attract globally mobile professionals who make money from outside the country.
Similarly, the provisions for real estate owners and retirees point to a larger policy of encouraging long-term residents who contribute to the economy without entering the local labor market.
The humanitarian category, which requires a direct determination from the Chairman, allows authorities the flexibility to accept circumstances that do not fit neatly into the other eight categories.
