Kano High Court Sentences Abdulaziz Umar to Death by Hanging for Culpable Homicide

A High Court sitting in Kano has convicted Abdulaziz Umar, a resident of Fagge Quarters, on charges of armed robbery and culpable homicide, and sentenced him accordingly.

Delivering judgment, Hon. Justice Zuwaira Yusuf held that the prosecution had discharged the burden of proof beyond reasonable doubt. The court imposed life imprisonment for the offence of armed robbery and a sentence of death by hanging for culpable homicide.

Justice Yusuf declared: “I hereby sentence the convict to life imprisonment for robbery and to death by hanging for culpable homicide until he is certified dead.”

The prosecution, led by Aisha Salisu, informed the court that the incident occurred on October 1, 2020, at Race Course, Badawa Layout, Kano, during Independence Day celebrations. Umar was alleged to have stabbed the deceased, Mubarak Salisu, in the stomach and hand with a sharp knife, causing fatal injuries, and thereafter dispossessed him of his Samsung mobile phone.

To establish its case, the prosecution called five witnesses and tendered documentary evidence. The offences were said to contravene Sections 298 and 221 of the Penal Code.

The defendant, however, denied the allegations. His counsel, Ya’u Abdullahi, presented him to testify in his own defence.

The court, after evaluating the evidence, found the prosecution’s case credible and sufficient to sustain the charges, thereby convicting Umar and pronouncing sentence in accordance with the law.
