While Mr. Titilola Olawunmi; Mr. Samuel Olusegun Olawunmi; Mr. Olugbenga Olukoya; Mr. Alaba Adefuye and Mr. Sanya Oladapo, for themselves & on behalf of the entire Adekoya Ofirigidi family of Odogbolu, Ogun State, and unknown person/Occupier were listed as respondents/defendants.

The first to fifth defendants through their lawyer, Chief A. G. Giwa-Amu, prayed for court order, directing the Inspector-General of Police and other senior police officers listed above to investigate the alleged forged document and report their findings to the court within two weeks or another period prescribed by the court.

The defendants said their application is pursuant to Sections 66(a) and (b) of the 1999 constitution (as amended); Section 88, 89 and 109 of the Administration Of Criminal Justice Act (ACJA) 2015, or ACJL Lagos, Section 115 and 117 of the Evidence Act, Section 363-368 Of The Criminal Code Law Laws of Lagos State, and under the court’s inherent jurisdiction.

The first to fifth defendants have alleged that the affidavit, purportedly sworn to by Mr. Ajayi Adefeyisan, a bailiff of the Ogun State High Court, Ijebu-Ode Judicial Division, was forged. And that Adefeyisan had denied being the author of the affidavit dated September 22, 2026, which was allegedly filed in support of an ex-parte motion dated September 8, 2026.

The defendants claimed that the disputed affidavit forms part of the records in the substantive land dispute before the Epe Judicial Division of the Lagos State High Court.

The defendants in an affidavit supporting the application, deposed to by Prince Samuel Olawunmi Olusegun Anikinaiya, the second defendant in the suit, averred that their lawyer, Chief Giwa-Amu, contacted Adefeyisan by telephone on October 9 and 10, 2026, to verify the authenticity of the signature on the document.

Anikinaiya averred that the bailiff denied signing the affidavit and described the signature as a forgery.  Adding that the disputed document contained fabricated statements concerning the land in contention, including claims that the defendants had encroached on the property and erected buildings on portions of it.

The defendants also alleged that the affidavit was introduced to mislead the court and give the claimants an undue advantage in the pending litigation. They urged the court to protect the integrity of its proceedings by ordering a thorough investigation.

Consequently, the plaintiffs/applicants prayed the court for the followings: “an order of this Honourable Court directing Inspector General of Police, Nigeria Police Force, Force Headquarters, Garki, Abuja, or the Commissioner of Police, Lagos State Police Command, Ikeja, Lagos State, or the Commissioner of Police, Ogun State Police Command, Eleweran, Ogun State, or the Assistant Inspector General of Police, Zone 2, Onikan, Lagos, or the Divisional Police Officer, Nigeria Police Force, Epe Division, Lagos, and to all officers and men of the Nigerian Police Force, to investigate the alleged forgery of the Affidavit dated 2294 September, 2026, purportedly deposed to by Mr. Ajayi Adefeyisan, a Bailiff of the High Court of Ogun State, Ijebu-Ode Judicial Division, Ogun State, and filed along with Motion Ex-parte dated 8th of September, 2026, which process is before and is part of the Records of this Honourable Court.
