The defendant faces a three-count charge as seen on the charge sheet signed by Police Officer, CSP Sadiku Afolabi Ibrahim of Ikotun Police Station.
According to Count 1 on the charge sheet, the prosecution alleged that sometime in March 2026 at Adetule Michael Street, Abaranje, Lagos, Sunday Fatomilola, with intent to defraud, obtained the sum of N370,000 from one Chief Ifeanyi Eneh under the false pretence to erect a parapet on his building. The prosecution alleged the presentation was known to the defendant to be false.
The prosecution stated that the alleged act in Count 1 is contrary to Section 313 and punishable under Section 314 of the Lagos State Criminal Law, 2015.
Count 2 on the charge sheet alleged that on the same date, time, and place, Sunday Fatomilola stole N370,000 cash and one 2.7 KVA generator valued at N480,000. The total value of cash and property alleged to have been stolen is N850,000, property of Chief Ifeanyi Eneh.
The prosecution alleged that the act in Count 2 is contrary to Section 280 and punishable under Section 287 of the Lagos State Criminal Law, 2015.
Count 3 alleged that on June 14 and June 15, 2026 at about 10:45pm and 4:48am respectively, the defendant conducted himself in a manner likely to cause breach of peace. On the charge sheet, it was alleged that he unlawfully paraded and constituted nuisance at the house and premises of Chief Ifeanyi Eneh by harassing him with words including threats to terminate his female children’s life, kidnap his son, and terminate his life.
The prosecution alleged the conduct in Count 3 is contrary to and punishable under Section 168(d) of the Lagos State Criminal Law, 2015.
Court documents show the defendant was arraigned on June 18, 2026. The record indicated the plea entered was “Not Guilty”.
The prosecutor, Inspector Simeon Njue, then asked the Court to give a date for hearing to enable the Police to provide evidence.
The Presiding Magistrate, Miss Ogunkoyede, granted the defendant bail in the sum of N200,000 with two sureties, tax clearance, and verification. The bail conditions were listed as part of the court order section.
The charge sheet listed CSP Sadiku Afolabi Ibrahim as the Police Officer and ASP Oluyemisi Juliana as the Investigating Police Officer. The matter was handled at Ikotun Police Station.
The case was adjourned till 10th July, 2026 for mention. File number Lccs/0626/1812589 was also noted on the document. The defendant was remanded in custody at the Correctional Center at Kirikiri town, Lagos, pending when he will perfect his bail conditions.
It is important to note that all allegations contained in the charge sheet remain allegations until proven in court. The defendant is presumed innocent until proven guilty under Nigerian law. The court has not delivered judgment on the matter.
The complainant, Chief Dr Ifeanyi Eneh, commended the Chairman, Bar. Shola Coker and the leadership of Ifeoluwa CDA for the prompt response over the matter to maintain peace in the area.
