EFCC denies political motive in Malami’s continued detention

The Economic and Financial Crimes Commission (EFCC) has dismissed claims by former Attorney-General of the Federation and Minister of Justice, Abubakar Malami, SAN, that his bail was revoked because he attended a political gathering in Kebbi State.

In a statement issued on Saturday by its spokesperson, Mr Dele Oyewale, the anti-graft agency insisted that Malami’s continued detention has nothing to do with politics, media appearances or political activities, but is solely the result of his failure to meet the conditions attached to the provisional administrative bail earlier granted to him.

The EFCC described the allegations as misleading narratives circulating in the public space, stressing that there was no political motivation behind its actions.

“The Economic and Financial Crimes Commission, EFCC, though not disposed to joining issues with respect to its operations in the media, is compelled to respond to the patently false claims of a former Attorney-General and Minister of Justice, Abubakar Malami, SAN, about a purported revocation of his bail over attendance at a political gathering in Kebbi,” Oyewale said.

According to the commission, Malami was granted provisional administrative bail after a brief interrogation on 28 November 2025. However, the bail was subject to five specific conditions, none of which the former minister has fulfilled.

The EFCC emphasised that administrative bail is neither an automatic right nor an entitlement, but a discretionary and temporary relief granted to suspects while investigations are ongoing and before possible arraignment in court.

Oyewale explained that since Malami failed to comply with the stipulated conditions, the question of bail revocation did not arise, as the bail had not effectively taken effect in the first place.

“The suspect’s continued detention is not politically motivated. It has nothing to do with any political gathering, media interview or any other extraneous consideration,” the spokesperson added.

The commission reiterated its commitment to professionalism and due process, noting that its investigations are guided strictly by the law and evidence, regardless of the status or political affiliation of those involved.

The EFCC urged the public to disregard claims linking its actions to political considerations, maintaining that its mandate is to investigate and prosecute economic and financial crimes without fear or favour.

Malami, who served as Attorney-General and Minister of Justice under the previous administration, is currently under investigation by the EFCC over allegations relating to financial impropriety, although the commission has yet to disclose full details of the case.

The agency assured Nigerians that further actions on the matter would be guided by the outcome of its investigations and in accordance with established legal procedures.
