The National Prosecuting Authority of South Africa (NPA) has welcomed a landmark judgment delivered by the Pretoria High Court which sentenced 57-year-old Peter Johannes Smith from Brits to life imprisonment for the brutal murder of his wife Theonette Smith.
Smith was also sentenced to an additional five years direct imprisonment for defeating the ends of justice. The court ordered that this sentence run concurrently with the life term effectively sealing his fate behind bars.
The court heard that the fatal incident occurred on the night of 12 October 2024, when the couple were at their residence celebrating Smith new job appointment while consuming alcohol. What began as a moment of celebration quickly descended into a deadly confrontation after an argument escalated between the pair.
During the altercation the deceased allegedly slapped Smith after which he responded with repeated violent blows to her head. The court found that the assault caused Theonette Smith to collapse and die on the spot after which the accused left her body in the living room and went to sleep.
In a chilling turn of events the following morning, Smith transported her half-naked body to a nearby veld and dumped it before returning home to report her as missing at the Brits police station. His attempt to mislead authorities unravelled when police received a tip-off about a body discovered in the veld and subsequently linked him to the scene.
Further investigation revealed blood stains in his vehicle and inside the couple home leading to his immediate arrest. He has remained in custody since his bail application was successfully opposed by the State.
During the trial State Prosecutor Adv Vusimuzi Tshabalala presented compelling forensic and pathological evidence that firmly established Smith’s guilt beyond reasonable doubt. A Victim Impact Statement read by Court Preparation Officer Lebogang Lebese detailed the devastating emotional toll on the couple daughter who described severe psychological trauma and the loss of her primary support system.
Although the defence argued for leniency citing Smith lack of prior convictions employment status and claims of alcohol influence the court rejected these submissions. Acting Judge Melissa Jordan found no substantial and compelling circumstances to deviate from the prescribed minimum sentence emphasising the accused abuse of trust lack of remorse and deliberate attempt to conceal the crime.
The court further noted that Smith a trained karate practitioner possessed full control and awareness of his actions. His conduct in disposing of the victim body was described as degrading and inhumane.
The NPA reaffirmed its commitment to tackling Gender-Based Violence, stating that justice had been served for the victim and her family.
