In a decision that has sent shockwaves through the KwaZulu-Natal north coast, the Esikhawini Regional Court has handed down a sentence of life imprisonment to a man who is 35 years old for the brutal rape of an eight-year-old girl. This decision brings an end to what the prosecution has described as one of the most harrowing betrayals of innocence in recent memory.
In a case that the National Prosecuting Authority (NPA) referred to as the “ultimate breach of trust,” the convicted predator, whose identity has been withheld to protect the confidentiality of the victim, was found guilty of preying on the small youngster in Empangeni. The case was classified as the most serious breach of trust ever committed. According to the testimony presented in court, the perpetrator of the sexual assault seduced the victim before committing a sexual attack that was so heinous that it left the youngster with both physical and psychological scars.
Sipho Mkhwanazi, the attorney for the state prosecution, created a terrifying picture of the offence, putting an emphasis on the deliberate nature of the attack. This was not an instance of bad judgement; rather, it was a premeditated act of predatory behaviour directed on a youngster who was defenceless. During the course of the trial, Mkhwanazi contended that the accused shown a complete lack of compassion by treating the victim as if it were an object for his own sense of satisfaction.
During the delivery of the sentence, Magistrate Thembeka Ndlovu made it quite plain that the level of tolerance that society has for gender-based violence and the abuse of children has reached its complete and utter limit. There is a responsibility on the part of the courts to remove such predators from our communities. The magistrate stated that the only appropriate and just response to a crime of this scale is to sentence the defendant to life in prison.
The victim, who is currently participating in ongoing trauma counselling, had assistance in court from members of the Thuthuzela Care Centre, which is a facility that provides survivors of sexual violence with a single point of contact. Reiterating that the long arm of the law would not show any mercy to those who target the most vulnerable sections of society, the (NPA) has expressed its appreciation for the speed with which the matter was resolved.
