Passanger Sues Virgin Atlantic for Lost Luggage, Demands $4,000 Plus N20 Million in Damages

Rabiu claims the airline breached their contract when his properly tagged luggage failed to arrive at Murtala Mohammed Airport. Despite waiting at the baggage carousel until it was switched off and all other passengers had collected their belongings, his luggage never appeared.

The plaintiff immediately reported the incident to Virgin Atlantic staff and completed a loss of baggage form as instructed. However, he alleges the airline has neither returned his luggage, provided a replacement, nor compensated him for the lost items.

In his suit, Rabiu is seeking $4,000 for the value of the items in his stolen luggage and N20 million in damages for distress, inconvenience, and legal fees incurred while attempting to recover his belongings.

Virgin Atlantic denies allegations of fraud, recklessness, and negligence, claiming they could not trace the luggage due to “inadequate information” provided by Rabiu on the property irregularity form. The airline has also argued that if found liable, any compensation should be limited to the provisions outlined in the Montreal Convention 1999, as incorporated in the Nigerian Civil Aviation Act, 2023.
